Can I Sue Hospital for Giving Medicine to Pregnant Women??

Question by ldr5455: Can i sue hospital for giving medicine to pregnant women??
I am 7 months pregnant and broke my arm Sunday afternoon. I didn’t want to take any strong medication. Plus i am methadone which is another reason why i couldn’t take a strong narcotic. The hospital gave me nubain, which is still an opiate, and the medication put me instantly in with draw. It was the worst feeling ever and caused me have seizure like chills, the sweats, yawning, runny nose, goose bumps. All withdraw symptoms. This could have cause me to go into labor or possible kill the kid. You should never go through with draw pregnant. The hospital should have known that you cannot give a methadone patient that type of medicine. Especially a pregnant methadone patient. Us there anything i can do about this, i have had these symptoms since Sunday and they are just starting to go away, and i am just lucky nothing happened to my baby…..
The hospital new i was on methadone and knew my dosage. If anyone knows anything about the drug, certian medications cause instant withdraw whether u take them once or 100 times. I asked what the side effects would be and they told me that there were none, and that they have given it others in my situation. hen i talked to my doctor, he told me they never gave it to any one on methadone but had no clue that it caused those immediate symptoms.
this was given to me at the er in the labor n delivery unit of my hospital. I signed no paper work-nothing. It was either nubain or morphine i chose nubain thinking it was better then morphine

No, you can’t. You chose to take the medication and you sign legal rights, aside from malpractice, away when you go to a hospital and consent to procedures/medication. I would see your OB or usual doctor to confirm that the hospital did anything inappropriate before you jump to conclusions. You aren’t a doctor, so you may not know why they chose the course of action they did.

I think the only time you can sue is if something actually happened to the baby or you noticed something isn’t right in the development. It’s a tough decision to make if you need pain meds.

You’re trying to get something out of nothing. You could have refused the medication, and you didn’t. You WILL NOT get “withdrawal” from using them ONE TIME. It’s perfectly ok to use narcotic pain relivers when pregnant as LONG AS YOU DON”T ABUSE THEM..which it sounds like you may have. You should not have had withdrawal from TAKING the drug ONE TIME. No,you can’t sue the hospital. They did nothing wrong. Did you lie about being on the methadone? If you did, then it’s your fault if they didn’t know. You didn’t tell them. Get a life. Get a job. Quit trying to find reasons to sue people that are POINTLESS.

You can try. Contact a lawyer there are plenty ambulance chasers in your yellow pages, (personal injury) We live in a sue happy nation so it wouldn’t surprise me if you could easily find someone to take your case. Good luck.

You have to prove damages to sue. Your baby is fine, you are fine, there are no damages.

You had your doctor’s ear at the hospital and did not ask about the medication side effects. When you went to fill your prescription the pharmacist made you sign a paper saying you had no questions for the pharmacist. You asked no questions and willingly took the medication.

Your baby is fine so just call this a learning experience. No matter what you are prescribed you should always ask both your doctor and your pharmacist about how it will interact with other medications, what its side effects are, etc. You are in charge of your health care.

no i dont think you can, you chose to take the medication there for your just in the wrong as they are.

If you disclosed the information to the hospital and its documented on file that you the patient are pregnant, you may have a case because having a seizure is pretty serious. Be aware that they will check your medical history and if you didn’t tell them any single thing like an allergy, other medications or whatever –your wasting your time. If you didnt tell them you were pregnant and they have proof because it wasn’t documented that day you went in. You have no case.
