I paid my 1st months rent and received the keys but the following day the landlord said he couldn’t rent to me because I was in a methadone clinic. He knew this before he took my check.I just wanted to know if this was legal for him to do? He lied and said he tried to get ah old of my last landlord and said the number was disconnected which it wasn’t because I called him on it after he said that. this landlord knew 4-5 days before we even met in person about the clinic. My last landlord was giving me a good Reference and all. I have lived at my past place 3 years with out any trouble and always paid my rent on time.

Although you may have been discriminated against, discrimination is not illegal. It’s only illegal for certain types of discrimination, such as based on race, religion, or gender. “Recovering heroin addict” is not a protected class of people.

I’m not condoning such discrimination. I’m just telling you it’s probably not illegal.

landlords have the right to refuse to rent to undesirables, . Junkies are undesirables. you have not been discriminated against in any illegal way.Drug addiction and use is legal cause to refuse teneancy.

it sounds like you are and that isn’t right you shouldnt have to be treated this way… you should find another place to live and sue the guy for deformation of character… you have the right to be in the clinic and you have the right to live there so stand up for yourself and take a stand

Have you both signed the lease? If you have, what he has done is not legal. Call legal aide, you can get the number from 411, but I would need a little more info about the lease etc.

Here is the only thing I don’t understand about this whole situation. Why would you have told him you were in the clinic. Why was this information that he needed at all.

I’m not sure if you have an legal protections or not, you may. But each state has it’s own landlord/tenant laws. You would have to hire a real estate lawyer to no for sure. To be honest it’s probably not worth it. If he returned you money and your out nothing go find another apartment. And stop telling potential landlords things that are none of their business.
